On 13/06/2011 The Instruction court Nº 5 in Torremolino archive de case against the company HOLIDAY ADVICE BUREAU S.L. declaring the Spanish jurisdiction would not have enough knowledge of the case.
D. Marcelo Fabián Ramírez had recourse to appeal, alledging that the mis demeanours were carried out with in Spain. The Provincial hearing in Malaga admitted the appeal allowing a time frame of 5 days by the Fiscal Ministry for confirmation of the recourse and the relevant supplied the appeal on 25/06/2011 under article 23 of the L.O.P.J.
